Terms of Service

1. Services

Eye for Boudoir is a trading name of Sally Burley and Trev Burley, contactable at studio@eyeforboudoir.co.uk. Our address for service is: Eye for Boudoir, BA 703, Nexus Connect, Esh, Durham, DH7 9QR — post only, not a studio or visitor address, so please email rather than write if you need an answer quickly. Sessions are photographed in Emsworth, Hampshire and across the surrounding area. In these terms "we", "us" and "our" mean that business, and "you" means the person booking a session.

We provide professional boudoir photography services as described in our experience. The scope of each session is agreed at the point of booking and during the pre-shoot consultation.

2. Booking and payment

A non-refundable booking deposit of £150 is required to secure your session date. This covers studio hire costs that we cannot reclaim once your date is held. The remaining balance is due no later than 7 days before your session date. Failure to pay the balance by this date may result in the session being cancelled and the deposit forfeited.

We accept payment by bank transfer, credit/debit card, and cash. Instalment arrangements for a larger experience can be discussed on a case-by-case basis.

3. Age requirement

All clients must be aged 21 or over. We reserve the right to request proof of age before confirming any booking. Sessions will not proceed if age cannot be verified.

4. Cancellation, rescheduling & refunds

Deposits

The £150 booking deposit is non-refundable. Because we cannot reclaim studio hire costs once your date is reserved, this amount cannot be returned regardless of when a cancellation occurs.

Session cancellations by the client

Any amount paid above the £150 deposit is refundable in line with the following schedule. For example, if you paid the full session fee upfront, the refundable portion is everything above the initial £150.

  • 14 or more days before the session: Full refund of everything paid above the deposit.
  • 7-13 days before the session: 50% refund of everything paid above the deposit.
  • Less than 7 days before the session: No refund of anything paid above the deposit.

Rescheduling

If you need to reschedule, we require at least 48 hours' notice. Because we book the studio immediately upon receiving your deposit, rescheduling means we incur a new studio hire cost for your replacement date. A studio hire fee of £150 is therefore payable to secure a rescheduled date - this is in addition to your original deposit, which covered the cost of the date you are moving away from.

With less than 48 hours' notice we will do what we can, but the date may have to be treated as a cancellation under the schedule above.

Rescheduling is subject to availability. You may reschedule up to twice.

No-shows

If you do not attend your session without prior notice, we treat it as a cancellation with less than 7 days' notice: the deposit is forfeited, and anything paid above it is not refunded. We do not charge more than you have already paid, and if we are able to fill the slot we will refund what we recover.

Cancellations by Eye for Boudoir

In the unlikely event that we need to cancel your session, you will receive a full refund of all money paid, including the deposit. We will make every effort to offer an alternative date.

Special circumstances

We understand that life is unpredictable. If you're facing exceptional circumstances (serious illness, bereavement, etc.), please get in touch and we will review on a case-by-case basis. We aim to be as flexible and compassionate as possible.

5. Gift vouchers

Gift vouchers can be purchased online via our website. The following terms apply to all gift vouchers issued by Eye for Boudoir.

Validity and redemption

Vouchers are valid for 12 months from the date of purchase and can be used in full or in part towards any Eye for Boudoir session or print products. Multiple vouchers may be combined. Any remaining balance can be paid separately. To redeem a voucher, simply quote the voucher code when making your booking enquiry.

Age requirement

Recipients must be aged 21 or over. This applies in addition to the general age requirement set out in Section 3. Vouchers will not be accepted if the recipient does not meet this requirement.

Transferability and cash value

Vouchers are transferable - they may be passed on or gifted to another person. Vouchers have no cash value and cannot be exchanged for money, in whole or in part.

Refunds on gift vouchers

You have a 14-day cooling-off period from the date of purchase. A full refund will be issued provided the voucher has not yet been redeemed. Once a voucher has been redeemed (i.e. used to book or part-pay for a session), it is no longer eligible for a refund.

If Eye for Boudoir is unable to fulfil a booking made using a voucher due to circumstances on our side, a full refund will be issued.

To request a refund, contact us at studio@eyeforboudoir.co.uk quoting your voucher code.

Expiry

After 12 months a voucher can no longer be redeemed against a session at the price it was bought at, and any promotional or bonus value attached to it lapses. The amount actually paid does not disappear. Get in touch with your code and we will honour that amount against a booking at our current prices. We would rather you used it.

6. Intellectual property

All photographs produced by Eye for Boudoir remain the intellectual property of Eye for Boudoir. Upon delivery of your purchased images, you receive a personal use licence to print, share privately, and use the images for non-commercial purposes. Commercial licensing can be arranged separately.

We will not publish or display your images without your explicit written consent, and you may withdraw that consent at any time without giving a reason. Section 4 of our Privacy Policy sets out what happens when you do.

Volunteer sessions are not covered by these terms. Where a session is given free of charge in exchange for the right to use the images, the arrangement is governed by the separate volunteer agreement signed before the shoot, and the position on image use is different — see section 4 of the Privacy Policy.

7. Client responsibilities

Clients are responsible for arriving on time, in the agreed state of preparation (outfits ready, etc.), and in a suitable condition to participate. Clients under the influence of alcohol or substances may be refused their session with forfeiture of the deposit.

8. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights under the Consumer Rights Act 2015 — including the right to services carried out with reasonable care and skill — are not affected by anything on this page.

Subject to that, we are not liable for indirect or consequential losses, or for loss of earnings, and our liability for anything else is limited to the amount you have paid us for the session in question.

Boudoir involves poses, movement and sometimes furniture or props. If anything feels unsafe or uncomfortable, say so and we will change it — and we are not liable for injury caused by acting against our guidance or an express instruction.

10. Your statutory cancellation rights

This section sits alongside section 4 and does not replace it. Where the two differ, whichever is better for you applies.

Because you book with us online, by email or over the phone rather than face to face, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days from the day the contract is made to cancel for any reason and receive a full refund, including the deposit.

To cancel, just tell us in writing — email studio@eyeforboudoir.co.uk or write to us at the address in section 1. You do not need a form or a reason; "I'd like to cancel my booking of [date]" is enough. We will refund you within 14 days of receiving it, by the method you paid.

If your session falls inside those 14 days, we need your express request for us to start work — holding the studio and preparing your shoot — before the period ends. If you ask us to and then cancel, you keep the right to cancel but may be charged for what we have already done, in proportion to the whole. If your session goes ahead within the 14 days, the right to cancel ends once the service is fully performed. We will ask you to confirm this in writing when you book a date that close.

Gift vouchers have their own 14-day period, which runs from the date of purchase — see section 5.

11. Complaints

If something has gone wrong, tell us first. Email studio@eyeforboudoir.co.uk with what happened and what you would like us to do about it. We will acknowledge within 3 working days and give you a full response within 14 days.

If we cannot resolve it between us, you retain every right you would otherwise have, including the right to bring a claim in the courts of England and Wales. We are not currently a member of an alternative dispute resolution scheme. Complaints about how we have handled your personal data can also go to the Information Commissioner's Office — see our Privacy Policy.

12. Changes to terms

We reserve the right to update these terms at any time. Updated terms will be published on this page. The terms that apply to your booking are the ones in force when you booked.

13. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
